Civil Rights Restoration

Under new Florida rules, many returning citizens can apply for clemency and restore their civil rights, instead of pleading at a clemency board hearing.

How to Apply

⇒ Complete an official application form.

• An application must be submitted using the form provided by the Office of Executive Clemency. These application forms will be available online at www.fcor.state.fl.us .

⇒ Collect and prepare supporting documents.

• The clerk of court for the circuit where your charges were filed can provide you with various documents for free. The Office of Executive Clemency or Florida Commission on Offender Review (FCOR) may also assist with preparing applications in certain situations.

Required documents:

→ A certified copy of the charging instrument (indictment, information, or warrant with supporting affidavit) for each felony conviction.

→ A certified copy of the judgment and sentence for each felony conviction, which may include an order of community control or order of probation for each felony conviction, felony charge for adjudication of guilt withheld, or misdemeanor conviction or charge.

Optional documents:

→ Character references, letters of support, a statement, and any other documents that are relevant to your application for civil rights restoration. Documents that are not relevant will not be kept.

⇒ Submit an application.

• The application and supporting documents must be submitted to the Office of Executive Clemency.

⇒ Keep these things in mind while you wait for your application to be processed:

• Be sure to let the Office of Executive Clemency know of any change in the information provided in your application, including contact information.

→ If your application fails to meet the requirements of the Rules of Executive Clemency, the Coordinator may return it without further consideration.

→ If your application meets the requirements, the Florida Commission on Offender Review will try to notify any victims; the respective State Attorney’s Office; the Office of the Statewide Prosecutor, if applicable; and the Office of the Attorney General, Bureau of Advocacy and Grants.

→ If you do not qualify for voting rights restoration under Amendment 4 (and therefore do not qualify for automatic approval of civil rights restoration upon processing of your application), the FCOR will provide an investigation, report, and recommendation to the clemency board on your application. You must comply with any reasonable requests from the FCOR in order to facilitate the investigation of your case. Failure to comply with these requests without adequate explanation may result in closure of your application.
